Effective date: January 1, 2026.
These Terms of Use govern the use of the Atendo platform by the Customer and End Users.
For the purposes of these Terms, the Customer is a legal entity, entrepreneur or other business subject that has contracted the right to use the Atendo platform directly with Nik-Com or through an authorized distributor or sales partner.
An End User is an individual to whom the Customer has granted access to the platform, including employees, associates, administrators and other authorized persons.
The Provider is Nik-Com, the owner and technical provider of the Atendo platform.
Atendo is a software platform intended for recording employees' working time, shifts, locations and field activities.
These Terms apply regardless of whether the right to use the platform was contracted directly with Nik-Com or through an authorized distributor or sales partner.
By accessing or using the Atendo platform, you confirm that you have read, understood and accepted these Terms, as well as the following documents which form an integral part of them:
If you do not agree with these Terms, do not use the Atendo platform.
In the event of a discrepancy between the legal documents relating to the use of the Atendo platform, the following order of precedence applies:
The Customer determines the persons to whom it grants access to the platform and is responsible for managing their user accounts and access rights.
End Users use the platform within the authorizations granted to them by the Customer.
The Customer has administrative control over End Users' accounts in accordance with the platform's functionalities. If you use Atendo within an organization that is the Customer, your access and data are subject to that Customer's internal policies, and the Customer has administrative control over your account.
Use of the Atendo platform requires creating a user account. The Customer undertakes to:
The Customer is responsible for all activities carried out through its account.
The Provider grants the Customer a limited, non-exclusive, non-transferable and revocable license to use the Atendo platform, exclusively for internal business purposes, in accordance with these Terms.
Assignment, sublicensing, or use of the platform contrary to its intended purpose is not permitted.

The Provider reserves the right to temporarily suspend or permanently terminate an account in the event of a breach of these rules.
All intellectual property rights relating to the Atendo platform, including the software, design, interface, documentation and accompanying content, belong to the Provider or its licensors.
Copying, modification, distribution or reverse engineering is not permitted without prior written consent.
The Customer retains ownership of the data and content it enters into the platform, but grants the Provider the right to process that data solely for the purpose of providing the service, in accordance with the Privacy Policy and the DPA.
Feedback, suggestions and proposals submitted by the Customer may be used to improve the platform without any obligation to pay compensation.
Availability levels, response times and support are defined in the applicable Service Level Agreement (SLA), which forms an integral part of these Terms.
The Provider does not guarantee uninterrupted or error-free operation of the platform beyond the scope defined by the SLA.
The Atendo platform is provided "as is", without express or implied warranties.
The Provider is not liable for any indirect, consequential or intangible damages, loss of profit, or business interruption.
The Provider's total liability, if any, is limited to the amount of EUR 100, unless otherwise agreed under a separate contract.
The Customer may stop using the platform at any time.
The Provider may suspend or terminate access in the event of:
The Provider reserves the right to amend these Terms. Customers will be notified of changes via the platform or by email.
Continued use of the platform after the changes take effect constitutes acceptance of the amended Terms.
These Terms are governed by the laws of the Republic of Serbia.
The court in Novi Sad has jurisdiction over all disputes.
